The current harbor rules are part of the HOUSE RULES. Copies are available on the Club’s web site or from the office. The Board of Governors
periodically reviews/updates these rules.
The rules include: dates covered by the Summer well fee, rules regarding absences/vacancies and which boat each well is for.
“Fronting” for other non-members to store their boats is grounds for suspension or expulsion.
All those rules, including liability indemnification, insurance requirements, and waiver of subrogation, are incorporated herein, and the member,
by signing/accepting/submitting this application, agrees to those terms of the storage contract and these listed below regarding summer / winter storage.
No heaters of any kind may be used in the yard or on a boat stored for winter storage without the approval of the Fleet Captain.
Once BYC staff has set your boat upon its stands, you may not adjust, remove, or transfer stands without approval of the Fleet Captain.
All requests to schedule launch, haul out, relocation, or other services normally provided by the Club’s yard staff must be made to the Harbor Master in advance.
Haul out will be based on the procedure outlined in the Yard and Crane Rules and Regulations.
No boats will be stored in the main parking lot in front of the Clubhouse.
Application and proof of insurance (and proof of ownership if new/changed) must be submitted to the Fleet Captain at fleetcaptain@byc.com by Friday September 23, 2022.
Winter storage charges will be billed in October 2022 and must be paid within normal Bayview Yacht Club terms.
Spring launch will begin as soon as the weather permits. It is the responsibility of the applicant to ensure that the boat is prepared to launch by April 30, 2022 to avoid being charged a late fee.
All boats upon which extensive repairs or work are expected to be affected that could delay launch must contact the Fleet Captain to make appropriate arrangements for storage and launch.
Boats that have not scheduled launch by May 1, 2022 will incur a $200 charge plus a $1 per square foot per day penalty.
BYC acceptance of this application is at the complete discretion of the Fleet Captain and the Board of Governors of Bayview Yacht Club.

I hereby acknowledge receipt of and agree to conform to the general conditions regarding summer and/or winter storage
at Bayview Yacht Club as prescribed by the Board of Governors and the Fleet Captain of Bayview Yacht Club.
In addition, in consideration of being assigned Summer and/or Winter Storage at Bayview Yacht Club, the applicant hereby agrees to the following:
The Club does not assume any responsibility or liability to the boat owner for any loss or damage to said boat nor does the Club assume any
responsibility or liability of any character for any personal injury to the boat owner or to anyone whom he may invite upon the premises of
the Club, it being agreed that the boat owner for his protection, shall carry insurance covering the risks aforesaid and the Club shall have
the benefit of such insurance in all respects as if it were a named insured. The Club does not assume any responsibility or liability to the
boat owner for the loss of any articles or equipment that may be left on the boat or in the boat well above mentioned or in the docking, trailer,
or storage space.
The applicant acknowledges that the storage location of the applicant’s boat is at the sole discretion of the Fleet Captain and that the Fleet Captain may
reassign applicant to any well or storage space on a temporary or permanent basis at any time and
applicant further agrees to vacate the assigned well and make alternative arrangements for mooring or dockage at the applicant's sole expense
during such times as the Fleet Captain may direct in connection with special events, including but not limited to before, during and after the
Bayview One Design Regatta. In the event the applicant fails to vacate the well when requested, the Club is authorized to take such action as
may be necessary to relocate the boat to an alternative site at the applicant's sole expense.
Bayview Yacht Club shall be entitled to a possessory lien on said boat and/or equipment for any and all monies owed by the Owner to Bayview for said charges,
work performed, services rendered, materials furnished and storage incurred to the Owner, his boat or the boat’s equipment. Bayview may refuse to permit any
stored items to be removed from Bayview’s premises until all of the terms and conditions of this Agreement have been met. Such possessory lien may be enforced
in accordance with the Michigan Marina and Boatyard Storage Lien Act, PA 362 of 1998, or MCL 570.371 et seq. Bayview shall also have a maritime lien upon the
boat, engines, gear, equipment and appurtenances to secure payment for any and all work provided, services rendered, materials supplied and storage incurred to
the owner by Bayview during the term of this Agreement. In order to protect its interest in these items, Bayview may mechanically secure or remove the property
to a storage area until all amounts are paid in full. Bayview shall also be entitled to expenses incurred in the collection of amounts owed as allowed by the
terms and conditions contained herein that shall include but is not limited to actual attorney fees.
This contract creates a license rather than a bailment and is personal to the boat owner only for yacht / storage specified above and not assignable.
I HEREBY AGREE TO CONFORM TO THE CONDITIONS SET FORTH ABOVE.
